The EU Procurement Directive (2004/18/EC) has been transposed through the Decree of August 2006, no. 2006-975. The decree encourages inclusion of accessibility in public procurement. Under the technical specifications section in the Annexe to the decree, it says that whenever possible, [specifications] are established so as to take into account accessibility criteria for people with disabilities.
In addition, Article 3 of the ‘Loi pour la confiance dans l’économie numérique’, Law no.2004-575 provides that the State, collectives, public bodies and private persons responsible for public services shall ensure that people with disabilities can access ICTs at work. The obligation to provide equal treatment of employees creates an obligation that electronic equipment and software tools are made accessible, so it appears that public procurement should mention it. However, so far, there are no further explanations and no decree for this law. This article is a section of a law regulating electronic administration in France, more generally. Thus, it concerns all public and private organisations working on behalf of public services.
