Public procurement

Legislation/regulations

Germany has transposed the revised EU Public Procurement Directives and, in principle, this allows accessibility considerations to be included at the discretion of the contracting authority. Accessibility is not directly included in any procurement regulations; the Additional Contract Conditions is the place where accessibility requirements could, in principle, be placed.

The only directly relevant regulation for public procurement is again the Federal Disabled Equalization Law (BGG) and its related regulation (the BITV). The BITV contains a catalogue of requirements to be considered when a service contract is awarded for web design.

Other initiatives

It is reported that there is not yet much awareness amongst procurers or any ongoing policy discussion in relation to eAccessibility and public procurement.
